KSU still sidesteps questions

KENNESAW – Kennesaw State University officials issued a new position statement Friday on the Jessica Colotl case, sidestepping written questions the Journal submitted to President Dr. Dan Papp.

The president has had several media requests for interviews this week regarding Colotl, an illegal immigrant attending KSU, and is unable to grant them, said Arlethia Perry-Johnson, special assistant to the president.

“The immigration debate is volatile and center stage in our nation. However, KSU’s administration will not become embroiled in that debate. Our focus has been and remains on ensuring that we are in full compliance with all Board of Regents’ policies that address the classification of undocumented students,” according to the unsigned position statement sent by Perry-Johnson.

The statement also reiterated the school’s actions on Colotl’s behalf.

“The university attorney attempted to ascertain Ms. Colotl’s legal status and contacted her country’s consular officials and her attorney; she NEVER offered legal advice of any sort; The university’s chief student affairs officer contacted Ms. Colotl’s sorority sisters – who were speaking to the media on her behalf – to ascertain her status, and to inquire as to what assistance could be provided regarding her matriculation, etc.; and KSU’s president wrote a letter to the judge, asking that ‘WITHIN THE LETTER OF THE LAW,’ Ms. Colotl be permitted to complete her studies at KSU,” according to the statement.

“Since learning of Ms. Colotl’s immigration status, KSU’s administration has determined that she must be, and will be, charged out-of-state tuition rates for any future courses in which she enrolls at the university. There also has been conjecture regarding whether or not undocumented students at KSU receive either federal or state financial aid. For the record, neither form of aid is afforded to undocumented students at KSU,” according to the statement.

Among the questions the Journal had asked Papp is why public employees expended any time or effort assisting an illegal immigrant, and whether Colotl would be allowed to finish her spring-semester classes.

Federal law says post-secondary education is a public benefit, and illegal immigrants are not eligible for public benefits. But the statement issued Friday by KSU references Regents policy rather than federal law, and D.A. King, an anti-illegal immigrant activist says that is wrong.

The Board of Regents sets policy for the 35 public colleges in the University System of Georgia.

“The Board of Regents allowing an illegal alien into our publicly funded post-secondary education system is a violation of both federal and state law,” said King, who is considering initiating lawsuits in both federal and state courts against the Board of Regents, including seeking a temporary restraining order to stop all admissions until the Regents comes into compliance. Activists go after Cobb sheriff, say actions politically motivated

ATLANTA – Immigration activists at Jessica Colotl’s Friday press conference called for Cobb Sheriff Neil Warren’s resignation and went after several local and state politicians.

Activists and members of human rights groups joined Colotl – an illegal immigrant and Kennesaw State University student – and denounced Warren’s recent actions, calling them politically motivated.

“It’s really unfortunate that her family has been used by ‘Wild West Warren’ for a political ploy to score political points,” said Jerry Gonzalez, executive director for the Georgia Association of Latino Elected Officials. “It’s shameful that a law enforcement official would use the rule of law and the authority given to him by Cobb County voters to abuse that power and to create a massive manhunt for a college student, a non criminal.”

Warren maintains that he was enforcing the law, as is his duty under oath, and was not encouraged by anyone to pursue the situation.

Colotl, 21, was stopped on KSU campus March 29 for a traffic violation and later arrested for driving without a valid license. After Colotl was booked into Cobb Jail, she was turned over to immigration authorities. She was taken to the Etowah County Detention Center in Gadsden, Ala., on April 1, but was released May 5. Immigration and Customs Enforcement authorities agreed to defer any action against her for one year so she could return to her studies at the university.

On Wednesday evening, however, the Cobb Sheriff’s Office obtained a warrant for Colotl on a felony charge of lying to law-enforcement officials, based on a reportedly false address she provided upon her book-in at the Cobb County Jail in March. On Friday morning, Colotl turned herself into Cobb authorities and was released on a $2,500 bond.

Rich Pellegrino, of Cobb Immigrant Alliance, said his group would soon be asking for Warren’s resignation.

“Next week we will be releasing information we have documented proof that Sheriff Neil Warren has been selectively enforcing the law, looking to the side when other people have identity issues, other people who are friends of his have identity documents, false documents, we will be releasing that next week and calling for the resignation and removal of Sheriff Neil Warren,” Pellegrino said.

Gonzalez even called for President Barack Obama to step in, asking him to take away an agreement, known as 287(g), which Cobb County has with the U.S. Immigration and Customs Enforcement Agency to check the immigration status of everyone booked into the county jail. The Cobb County Sheriff’s Office was the first agency in Georgia to participate in 287(g). Since July 2007, Warren’s office has identified more than 6,600 inmates who were in the United States illegally. Warren signed a new 287(g) agreement in October 2009.

In defense of his latest actions, Warren said Friday that his staff went to the Duluth address that Colotl provided to his department during her first book-in and met with the manager of Century Park Apartments, only to find that Colotl did not live there.

“I have all the confidence in the world that my investigators did a thorough investigation,” Warren said. “And they presented a case to the magistrate, and the magistrate judge felt there was probable cause to issue the warrant. So it’s time for us to let the courts and the judge decide … We started getting calls and I felt obligated to look into it. I did not have any encouragement to do anything.”

Warren said he has no intentions of resigning.

Regarding Colotl’s late March booking in Cobb Jail and the tools used to determine the status of an inmate, Warren said, “some may think it is unfortunate that minor offenders are caught in the 287(g) net; but I value any tool that helps me enforce the law and remove violators from our community. Georgia law establishes legal criteria for every potential offender, from traffic violations thru capital felony murder. Often individuals have different perceptions or personal definitions of criminal activity. I follow the Georgia Code and enforce those statutes. That is my oath of office and duty to the citizens of Cobb County.”

Following Friday’s press conference, Christopher Taylor, Colotl’s attorney, was critical of the Journal for its reporting, saying the Journal was responsible for Colotl’s second arrest.

“I believe the Marietta Daily Journal and the Cobb County Sheriff’s Office misreported this issue,” Taylor said. “I’ve got a problem with the Marietta Daily Journal … Reporting that she gave a false address caused a fire storm.”

However, the Journal brought Colotl’s story to light on May 1 because her friends and sorority sisters from Lambda Theta Alpha Latin Sorority reached out to the newspaper, asking for coverage of a march for Colotl at the state Capitol.

In an attempt to contact Colotl, the Journal called her previous attorney, Kazuma Sonoda, of the Sonoda Law Firm, sent her a message via Facebook and finally went to the Duluth address she provided to authorities on May 7. At the address, a woman answered and said she still receives mail for Colotl, but has never met the KSU student.

Taking jabs at politicians Friday, Gonzalez said, “(Former) state Rep. Nathan Deal has said he wants to bring Arizona along to Georgia as governor. (Former) state Sen. Eric Johnson wants to ban access to college education to deserving students like Jessica. They want to kick them out of school. Is that the kind of Georgia that we want?”

Johnson, a Republican candidate for governor, on Friday challenged a statement from the chancellor of the University System of Georgia that it would be too costly to require verifying citizenship when a student goes through the admissions process.

“This is a typical bureaucratic response. First and foremost, we cannot afford to simply ignore the law, and it is unacceptable to brazenly dismiss the responsibility of enforcement,” Johnson said. “… It does not cost a dime to ask for a valid driver’s license, valid passport, or valid student visa.”

KSU officials have said that Colotl was receiving in-state tuition since she graduated from a Georgia high school.

Gonzalez went on to say that Georgia has “no leadership from both of our U.S. senators.”

“Where is Saxby Chambliss and where is Johnny Isakson? Instead of saying no on immigration reform, why are they not working to move forward with a workable solution that moves us together as a nation to uphold our values as a nation? (Isakson) You are up for re-election sir. There are a 160,000 Latinos registered to vote. We are paying attention to this issue,” he said.

In response, Isakson told the Journal, “I have always drawn a clear distinction between legal and illegal immigration, and anyone who comes to our country legally should be welcomed to share in the pursuit of the American dream. At the same time, the defense of our nation begins with securing our borders and ending the opportunity for illegal entry. Our immigration laws must be followed and they must be enforced, and I stand in full support of those who do both.” HERE

Panel: Stopping ‘Hate’ Is Really about Stopping Debate

WASHINGTON (March 10, 2010) – After the collapse of the Senate amnesty bill in 2007, the Southern Poverty Law Center (SPLC) joined with the National Council of La Raza and others to launch a campaign to smear the three largest mainstream groups making a case for tighter enforcement and lower immigration. At the center of this campaign was the designation of the Federation for American Immigration Reform as a ‘hate group’ and the spread of that taint to Numbers USA and the Center for Immigration Studies. The announced goal was to pressure journalists and policymakers not to meet or speak with these organizations. Touted as an effort to ‘stop the hate,’ it was a thinly disguised move to stifle debate.

CIS will release a report next week examining the SPLC and its role in this campaign. “Immigration and the SPLC: How the Southern Poverty Law Center Invented a Smear, Served La Raza, Manipulated the Press, and Duped its Donors,” authored by Pulitzer Prize-winning investigative journalist Jerry Kammer, will be released at a panel discussion on Thursday, March 18, at 9:30 a.m. at the Murrow Room of the National Press Club, 14th & F streets NW. Jerry Kammer, author of “Immigration and the SPLC” and Senior Research Fellow at CIS. Prior to joining CIS, he was awarded a Pulitzer Prize in 2006 for his work in helping uncover the Duke Cunningham congressional bribery scandal. He received the Robert F. I feel like taking a shower after writing about the Southern Poverty Law Center, but for some reason it’s taken seriously by the media and even government agencies, so I can’t avoid it. A couple examples this week of how ludicrous the SPLC’s charges of ‘hate’ are. James Taranto at the Wall Street Journal wrote ‘In Defense of Carol Swain’ in reaction to the SPLC smear-meister Mark Potok’s claim that ‘Carol Swain is an apologist for white supremacists.’ Taranto does a good job of assessing the issue at hand, especially remarkable from the WSJ given the fact that Carol is an immigration restrictionist, though that’s not what was at issue. I’ll add only that I know Carol, a black woman who went from being a teenage mom and high-school dropout to earning a PhD and teaching at Vanderbilt, and the very idea that she’s an ‘apologist for white supremacists’ is so outlandish, not to mention scurrilous, as to render whoever makes such a claim not credible on anything else. How can any self-respecting reporter ever quote Mark Potok again on anything?

Phoenix Mayor Won’t Let FAIR Attend Secret SPLC Briefing

The SPLC is staging secret meetings with Arizona law enforcement as well as Phoenix mayor Phil Gordon (add the dates of the meetings). The SPLC is planning on branding all Arizona groups that oppose illegal immigration as hate groups and individuals as “haters,” to try to intimidate them into toning down their opposition to amnesty and mass immigration. FAIR president Dan Stein wrote to mayor Gordon last month requesting FAIR be allowed to attend these secret meetings but the public has been barred from these meetings – designed to demonize patriotic Americans and inculcate suspicion of legitimate political activity in the police.

(Washington, D.C.) The Southern Poverty Law Center (SPLC) has launched its most irresponsible attack to date against the Federation for American Immigration Reform (FAIR). The SPLC claims that Shawna Forde, the alleged killer of a little girl and her father during an Arizona home invasion, had ties to FAIR. Although no association exists – or ever has – between Ms. Forde and FAIR, the SPLC and organizations advocating mass amnesty and open borders have used this tragedy to fuel their on-going smear campaign against FAIR and other immigration policy organizations in order to suppress free and open debate about immigration policy in the United States.

The Federation for American Immigration Reform (FAIR), an organization with a 30-year record of responsible advocacy for enforcement of immigration laws and overall reductions in immigration, categorically repudiates all acts of violence. FAIR draws a clear distinction between immigration policy and immigrants, who must always be treated with respect and dignity regardless of their immigration status.

FAIR has no association with Shawna Forde. “Ms. Forde is not and never was an employee, member, activist, or donor of FAIR and most certainly has never been authorized to speak on behalf of our organization,” stated Dan Stein, president of FAIR. “Ms. Forde misrepresented herself as a spokesperson for FAIR in a 2006 appearance on KYVE-TV in Yakima, Washington, and the producers of the program were remiss in failing to authenticate her false claims.”

Despite having spoken with the television station and learning that it was high unlikely Ms. Forde was associated with FAIR, the SPLC nonetheless disseminated information suggesting such a relationship existed. This latest attack represents an extreme and dangerous example of the vicious tactics of the SPLC – recklessly attempting to smear groups with whom they disagree, total disregard for the facts and the reputations of those involved and in this case, the disgraceful attempt to exploit the murder of a 9-year-old for self-serving purposes.

“What is truly disappointing about this smear campaign is that the American people lose. Immigration is a critical public policy issue that must be debated freely and openly,” continued Stein. “If these open borders organizations were truly concerned about good public policy, they would spend their time discussing issues and solutions. Instead, those who seek to exploit the deeds of a few extremists for their own political gain do so at the expense of the vast majority of Americans who believe that laws against illegal immigration must be enforced.”

I understand that you are doing a series of broadcasts on “Latinos” and “immigration”.

Some unsolicited insight:

“Immigrants” – like my adopted sister – by definition, join the American family lawfully, already enjoy a path to citizenship and do not require amnesty.

The same cannot be said for illegal aliens. This applies even to Hispanics.

We have nothing to apologize for when it comes to “immigration” as we as a nation take in more than one million immigrants a year from all over the world. More than any nation on the planet. Another two million or so “guest workers” many of whom scream “you can’t make me leave, I have an American born child and I like it here” !

Illegal immigration is slowing and illegals are leaving the U.S. because of increased enforcement, and the loss of job opportunities – exactly as those of us who fight that crime said would happen with the concept of “attrition through enforcement“.

We are proving that local enforcement works as a deterrent to illegal immigration – and the illegal alien lobby is howling.

The shameful presentation that Americans who demand secure borders and an equal application of the law are somehow “anti-Latino” or “anti-immigrant” is perpetuated by people who cannot find a reasonable argument for allowing everyone on the planet – or in Latin America – to come live in the USA. And because they have created a thriving business advocating for criminals.

The goal of the coaltion of the radical left and Wall St. is really open borders.

Here in the metro Atlanta area, we are nearly out of water, and there was talk three or four years ago of making I-75 twenty three lanes wide near my home. That will eventually happen. English has become an optional language in the American south and the flag of Mexico flies everywhere. Low skilled wages have been steadily declining for years.

Americans who cannot speak Spanish are being denied jobs for that reason in Georgia.

We are bailing out the banksters who illegally made mortgage loans to illegal aliens using Mexican ID.

We as a nation have the right to decide how many people we want to live in our republic and we certainly have the right to demand that our immigration and employment laws are enforced. Those of us who insist that criminal employers who draw the migrating wage-thieves here be punished are in the majority of the ever increasing number of aware and angry American people.

Sadly, the people with the courage to say exactly that are branded “racist” ( what race is illegal?) and “haters” by the race-baiting far left like MALDEF, La Raza, LULAC and that perpetual fund raising machine disguised as a law firm, the SPLC. That fact is either ignored or helped along and perpetuated by many in the MSM. The rocket scientist Rick Sanchez of CNN leaps to mind. I watched in November as he literally had an SPLC critter (Mark Potok) spew his usual hate mongering and name calling from a telephone on the air.

Sanchez literally had him phone it in!

My cat could easily defeat Sanchez (or Potok) in a debate. Having done many live CNN/FOX News hits, although I have a face for radio, I would happily paint the house belonging to any CNN producer who would get me on his show in place of my feline to expose his mindless open borders ethnic oriented agenda.

Mexico uses its military to try to secure its own borders and deports nearly as many people each year as we do….virtually all of whom are Hispanics.

Radical xenophobes and haters….si?

Most Americans don’t give a hoot about where a real immigrant comes from. But we do insist that they become assimilated and adopt to the American culture and language.

That ideal is not un-American.

We also understand that legalization – by any name – does not result in secured American borders, enforced employment laws or an end to illegal immigration. We proved that with the “one-time amnesty” of 1986. We will not forget the lesson.

Instead of the reported sixty “Latino leaders”, Obama would do well to schedule meetings with mainstream Americans who study immigration and the law. We know more about the issue than he does and we want what is best for the nation – not for special interest groups using ethnicity and skin color as victimhood and a basis for special treatment.

Obama would also do well to heed the advice of the late Barbara Jordan, the first black woman elected to congress and the Bill Clinton appointed head of his Commission on Immigration Reform from the 90’s. From Jordan in 1995: ” To gain credibility on immigration policy: “Those who should get in, get in; those who should be kept out, are kept out; and those who should not be here will be required to leave — deportation is crucial.”

On the criminal employers who lure illegals into our republic, Jordan recommended mandatory electronic verification of legal employment eligibility. “Employer sanctions can work,” she said.

Fortunately for Jordan, a 1994 Presidential Medal of Freedom award winner, 21st century ethnic hustlers, biased journalists with a clear agenda like Sanchez and Wall St. scammers in search of even more taxpayer subsidized “cheap labor’ weren’t there to attack her “extremism.” Si?

Heads up – the coming corporate funded attempt to repeat the amnesty of 1986 will be met with more defiant popular grass-roots resistance that the media – or the Congress – can ever imagine and the price of it passing would be a forever divided “new-America” that will simply become part of the envisioned “North American Community” dedicated to redistribution of the wealth, socialism and increased profit for those who are more equal in the disgusting barnyard of 21st century American politics.

Please pass this on to the suits at CNN HQ who may think they are fooling all of the people all of the time. And Sanchez.
