Official USCIS response to question on DACA status today – no legal status and no lawful presence #DDS

I recently sent a media request to USCIS concerning DACA and deferred action illegal aliens. Below is the reply.

Sent to USCIS Public Affairs Officer Pamela Wilson following Friday and Saturday phone conversations:

“Please provide an official answer. Does USCIS consider any deferred action on deportation recipient, including DACA beneficiaries, to have lawful status?

Separate question: Does USCIS consider any deferred action recipient, including DACA recipients, to have “lawful presence?”

Emailed reply from Ms. Wilson at USCIS today (emphasis mine):

“Hi Mr. King:

You may attribute the following me as “ Pamela Wilson, USCIS Spokesperson” or use “USCIS Officials” whichever you prefer, on the following official statements.”

“Current law does not grant any legal status for the class of individuals who are current recipients of DACA. Recipients of DACA are currently unlawfully present in the U.S. with their removal deferred.

Also, this link shows current DACA recipients in Georgia number 21,600. Data current as of June 30, 2017 shows that since inception, 24,234 individuals from Georgia have received an initial grant of DACA.”

AJC vs AJC – changing stats tracking DACA amnesty winners in Georgia #DDS

As we have asked before: How many illegal aliens are there in Georgia with Obama’s executive DACA amnesty?

On October 6, the AJC’s immigration story teller Jeremy Redmon cited a September 4 USCIS report that put the number of DACA illegals in Georgia at 21,600.

“That represents a little more than 2 percent of the 689,800 people who were participating in the Deferred Action for Childhood Arrivals program, or DACA, as of Sept. 4, according to a recent U.S. Citizenship and Immigration Services report. In all, there are 21,600 DACA recipients in Georgia.”

But in an October 13 DACA weeper, another AJC reporter, Vanessa McCray, tells us the number of DACA in Georgia is now 24,000:

“He is one of nearly 800,000 undocumented immigrants who came here as children, including about 24,000 in Georgia, whose American way of life is endangered unless President Donald Trump and Congress reach a deal to extend DACA.”

I sent a note of inquiry to McCray, but AJC reporters seldom reply.

A September 5 story from Redmon put the number at “24,135” as of last March:

“As of March, 24,135 people in the state have been granted a temporary reprieve from deportation and work permits through the Deferred Action for Childhood Arrivals program, or DACA.”

Huh.

Trump Administration Immigration Policy Priorities

Executive Summary

The Trump Administration is ready to work with Congress to achieve three immigration policy objectives to ensure safe and lawful admissions; defend the safety and security of our country; and protect American workers and taxpayers.

BORDER SECURITY: Build a southern border wall and close legal loopholes that enable illegal immigration and swell the court backlog.

• Fund and complete construction of the southern border wall.

• Authorize the Department of Homeland Security to raise and collect fees from visa services and border-crossings to fund border security and enforcement activities.

• Ensure the safe and expeditious return of Unaccompanied Alien Children (UAC) and family units.

• End abuse of our asylum system by tightening standards, imposing penalties for fraud, and ensuring detention while claims are verified.

• Remove illegal border crossers quickly by hiring an additional 370 Immigration Judges and 1,000 ICE attorneys.

• Discourage illegal re-entry by enhancing penalties and expanding categories of inadmissibility.

• Improve expedited removal.

• Increase northern border security.

INTERIOR ENFORCEMENT: Enforce our immigration laws and return visa overstays.

• Protect innocent people in sanctuary cities.

• Authorize and incentivize States and localities to help enforce Federal immigration laws.

• Strengthen law enforcement by hiring 10,000 more ICE officers and 300 Federal prosecutors.

• End visa overstays by establishing reforms to ensure their swift removal.

• Stop catch-and-release by correcting judicial actions that prevent ICE from keeping dangerous aliens in custody pending removal and expanding the criteria for expedited removal.

• Prevent gang members from receiving immigration benefits.

• Protect U.S. workers by requiring E-Verify and strengthening laws to stop employment discrimination against U.S. workers.

• Improve visa security by expanding State Department’s authority to combat visa fraud, ensuring funding of the Visa Security Program, and expanding it to high-risk posts.

MERIT-BASED IMMIGRATION SYSTEM: Establish reforms that protect American workers and promote financial success.

• End extended-family chain migration by limiting family-based green cards to include spouses and minor children.

• Establish a points-based system for green cards to protect U.S. workers and taxpayers.

“Deferred action is not a statute created or authorized by law or by congress…”

Below is page 15 of the 2015 Texas vs United States federal court order that stopped DAPA and the expansion of DACA – note the reference that deferred action is not a statute and was not created by congress. Nevertheless, in the process of going around the INA, it was used in the REAL ID Act to provide “lawful status” to illegal aliens so they can obtain a drivers license.

  • Question (again) – how is it constitutional to insert ‘deferred action’ into the REAL ID Act [see: SPECIAL REQUIREMENTS – (2) (B) EVIDENCE OF LAWFUL STATUS (vii) ] to provide “evidence of lawful status” to illegal aliens, thereby using an enforcement priority tool that is not law and was never authorized by congress to change the language, intent and result of the INA that was passed by congress? ——-Isn’t that the same as saying law enforcement has the power to invent a way to change federal immigration law if congress skips a step and nobody speaks up?

TYPOS abound. It looks like I mis-spelled the name of the corporation I am inquiring about. I had it “La Amistadt” – it is actually ‘LaAmistad’ – all one word, with no “t.” The City of Atlanta’s reply to me (below) tells me they have no record for “La Amsted” – different spelling from what I sent in. Odd. So, I have resent my request as a reply noting correct spelling. I just noticed another typo in my rush reply “entity” was typed ‘unity.”
