D.A. King, the illegal immigration activist, and representatives of the Georgia Association of Latino Elected Official get along like a house on fire.

If that house is also filled with kegs of gunpowder and roofing nails.

State officials have been known to insist that King and Jerry Gonzales, GALEO’s executive director, sit on opposite sides of the room at hearings.

So when the two sides agree on anything to do with immigration, we must pay attention. This morning’s topic is SB 40, state Sen. Jack Murphy’s attempt to require all businesses in Georgia to use the federal computer registry called E-Verify – or something like it – to make sure their hires are legal U.S. residents.

The bill includes this exemption, presumably intended for farmers:

This Code section shall not apply to any person or entity who has filed an H-1 or H-2 application, or similar type of application, with the United States Department of Labor.

Last week, King labeled the loophole “preposterous.”

“On illegal employment, the bill’s author has excluded so many industries from the badly needed required statewide use of the no-cost federal E-Verify system so as to make it a parody of an employment enforcement bill,” King said, promising to see the bill changed or killed.

King is not an immigration lawyer. But Charles Kuck, who calls himself the “token Republican” on GALEO’s board of directors, does have a shingle.

More than that, Kuck is also the past president of the American Immigration Lawyers Association. And Kuck says King is right.

On Friday, during a break in a hearing on state Rep. Matt Ramsey’s immigration bill, Kuck noted several flaws in the exception carved out by SB 47. Chief among them is the fact that it is the U.S. Department of Homeland Security that handles work visas – not the Department of Labor.

Kuck continued:

“There’s no such thing as an H-1 or H-2 petition….. Let’s presume [Murphy is] speaking of H1Bs, which are used by the AJC to hire foreign reporters, or Georgia Pacific to hire an engineer or, really, any company, and the H2As, which are [for] temporary agricultural workers, and H2Bs, which are [for] temporary, ‘other’ workers.

“Say I’ve got a landscape company, I just got a contract with the state to take care of the highways. I need 500 guys. I do an H2B, I bring in 500 workers. Those people – those employer who doesn’t use any of those – don’t have to enroll in E-Verify. That’s every employer in Georgia, potentially….

Hispanics flood Capitol to protest immigration bill

Dozens of Hispanic immigrants flooded the halls of the state Capitol today to voice their concerns over a bill under debate in the Senate that seeks to crack down on undocumented workers in Georgia.
Organizers of a morning rally on the Capitol steps urged the crowd of about 100 mostly Hispanic men to go inside to urge legislators to vote against Senate Bill 529, known as the Georgia Security and Immigration Compliance Act.

About half of the crowd lingered outside, in part because a photo identification is required to enter the Capitol building.

Inside, many of the immigrants, some of them whom acknowledged they are undocumented crowded hallways outside of the Senate chamber. Many of them wore blue jeans, t-shirts, stained painter’s pants, cowboy hats and ball caps, standing out from the suit-and-tie Capitol crowd that usually gathers in the halls.

Jerry Gonzalez of the Georgia Association of Latino Elected Officials guided several men through a legislative phone-and-photo directory, helping them pick out certain legislators with whom to speak. Many busily filled out message forms for legislators in hopes of getting them to come out of the Senate to hear them out.

Gonzalez said some of the men in the crowd who speak English were helping the Spanish-speakers to communicate with legislators.
“We want to put a face with immigrants” Gonzalez said. “Many of these immigrants live in their districts. Legislators should consider them their constituents.”

About 1 p.m., when debate over Sen. Chip Rogers’ (R-Woodstock) bill began, the majority of the immigrants moved up to the public gallery overlooking the floor of the Senate to watch the debate. Pablo Lopez, 28, of Gwinnett County, took a day off from his landscaping job to watch the debate in person.

Lopez, who acknowledged that he is an undocumented worker from Mexico, said he thought it was important to let legislators know immigrants are disturbed by the bill. Lopez noted that federal and state taxes are taken out of his paycheck every week. He wants to start his own landscaping business, but cannot do so because of his lack of legal status in the country.

“We work hard and I think it’s time they recognize the work we do, Lopez said.

ATLANTA – The American Civil Liberties Union in Georgia promised to sue if the General Assembly passes sweeping new legislation targeting illegal immigrants. Others say it’s a legal way to save millions of tax dollars and stop thousands of jobs that are going to people who have no legal right to be here.

An estimated 425,000 illegal immigrants live in Georgia, even have more than Arizona.

The FOX 5 I-Team got a public look at one of the bills aimed at reducing those numbers.
