Tamar Jacoby: Feds should stay out of Arizona’s fight

The Obama administration is considering suing Arizona to block implementation of its harsh new immigration enforcement measure, SB 1070. The Justice Department doesn’t have much time – barring a judicial stay, the law goes into effect July 29 – and a decision, to sue or not to sue, is expected any day.

SB 1070 is an abomination, no doubt about it, and the White House is under intense pressure to act. But a Justice Department lawsuit would be a horrendous mistake – one that could end all hope of passing comprehensive immigration reform as long as Barack Obama is president.

In a radical departure from settled law, the legislation makes illegal immigration a state crime in Arizona – until now, it has been a federal matter. Even more controversially, the measure authorizes and in some cases requires local police to probe the immigration status of people they have stopped for other legal reasons, including violations of municipal ordinances. All of that is bad enough, but the most devastating effect of SB 1070 may be political – the way it is poisoning the American immigration debate.

President Barack Obama, President Felipe Calderon of Mexico, the Roman Catholic Church, the AFL-CIO and a Who’s Who of Latino pop stars have denounced the legislation. Dozens of conferences and conventions scheduled to take place in Arizona have been canceled. And tens of thousands of people across the country have participated in demonstrations pillorying the measure as a racially motivated assault on immigrants and an invitation to ethnic profiling.

Meanwhile, on the other side of the divide, polls show that 60 percent of Americans support SB 1070. The polling hasn’t probed deeply, so it’s hard to say exactly why they endorse the law. Some supporters talk about stemming border violence and controlling crime – particularly the mob-style crimes committed by international smuggling cartels. Others, judging by talk radio and blog chatter, seem more bothered by the simple illegality of illegal immigration.

Few surveys, now or in the past, show voters to be particularly angry at unlawful immigrants or eager to punish them. But many are very angry at the dysfunctional immigration system – and at a political class that doesn’t seem bothered by millions of people making a mockery of the law.

For weeks, proponents and opponents have played off one another, passion fueling passion, charges sparking countercharges and rage, to the point that there’s almost no point in talking anymore – people on both sides are that entrenched.

Where one side sees law enforcement and personal security, the other sees racism. The very term “enforcement” has become a dirty word to many immigrants-rights activists.

And to the nearly two-thirds of Americans who back the measure, reform advocates look increasingly suspect – unwilling to admit an obvious truth (that illegal immigrants have broken the law) and far too ready to play the race card against those with legitimate concerns.

For both sides, immigration is becoming an issue of good versus evil. And in that kind of moralistic standoff, there is no middle ground – no room for politics or compromise.

It’s a disastrous course – and one all too familiar in American politics. How long before the immigration debate is as stalemated as the standoff on abortion? Each side sees the other as morally reprehensible. Each is sure it’s right. We as a nation can’t resolve the problem, but we can’t let go of it, either – and it soon poisons other issues, making it hard to do even basic things, like confirm judges.

An administration lawsuit against SB 1070 would only push immigration further in this direction. What’s needed is comprehensive immigration reform, a balanced, bipartisan bill supported by a broad national consensus. That’s what the administration should be focused on – developing consensus on immigration, not exacerbating a widening divide and closing off all possibility of compromise.

Penalties to increase for human smuggling

Mexico City – Mexico will begin to impose greater prison terms and fines for human traffickers. Federal officials announced that human trafficking will now carry penalties of 8 to 16 years in prison and fines of minimum 15,000 days’ salary. Up to now, the penalties were 6 to 12 years and 10,000 days’ salary. The new minimum fine translates to some $64,000. The penalties increase by 50% if it involves trafficking minors. The modifications in the law also now permits the authorities to instigate their own investigations. Previously, it required a citizen report of trafficking. Most of the human trafficking encountered in Mexico are those being transported through the country to enter the US. This not only includes foreigners, but Mexican citizens as well. [Ed. note: The “daily wage” fines are apparently based on Mexico’s minimum daily wage.]

San Pedro Sula, Honduras – At least 500 Hondurans leave daily for the US to seek “the American dream,” according to the regional human rights commission. The commissioner of the organization said that monthly, about 15,000 leave the country in search of jobs in the US. However, most of them are deported back, he added.

Some 20,000 Hondurans have left Arizona

Tegucigalpa, Honduras – Some 20,000 Hondurans have left Arizona due to the threat of SB 1070. The Honduran government has sent authorities to the state to lend assistance to their people. The Hondurans are seeking refuge in neighboring states like California and Texas, although they prefer California. This is due to two things. Some Texas counties are seeking to implement laws similar to Arizona’s “which violate the rights of the migrants,” while California is a state that is boycotting some of Arizona’s commercial and economic activities in protest to the law.

Mullis Co-authors Anti-Illegal Immigration Legislation

CHICKAMAUGA (July 6, 2010) – Senate Transportation Chairman Jeff Mullis (R-Chickamauga) will co-author legislation that will provide for greater enforcement of federal illegal immigration laws in Georgia. Mullis will join fellow Georgia Senate GOP colleagues later this summer for the official announcement of the legislation.

“The United States is a land of opportunity for all who want to come here and contribute to our society in a lawful manner. We welcome anyone who wants to become a legal resident of the United States to achieve the American dream. The fact remains that those who are reside illegally are breaking the law and utilizing resources that should be for those who obtain legal residency,” said Mullis. “Businesses, local governments and our university system must comply with federal and state illegal immigration laws to relieve wasteful spending and get legal residents and Georgians back to work.”

Facts on Illegal Immigrants in Georgia:

Georgia had an estimated illegal immigration population of 490,000 in 2008.
The Federation for American Immigration Reform (FAIR) estimates that the annual fiscal burden on Georgia taxpayers from illegal immigration is more than $1.6 billion.
Georgians spend about $1.37 billion annually on educating the children of illegal immigrants.
Nearly one in ten K-12 public school students in Georgia is the child of an illegal alien, and this presence has been increasing as the illegal resident population increases.
State-funded uncompensated outlays for health care provided to Georgia’s illegal alien population amount to an estimated $210 million a year.
The cost of incarcerating deportable aliens in Georgia’s state and local prisons amounts to about $22.6 million a year.

Federal Statistics:

The number of illegal immigrants in the U.S. roughly doubled, jumping from about 5 million in 1996 to about 11 million today. (A 2009 report from the Department of Homeland Security reflects that the number of illegal immigrants in the U.S. stands at around 10.8 million.)
Federal estimates suggest that over 90 percent of the increase in the foreign-born population in Georgia since 2000 has resulted from illegal immigration.

Growing emigration from Africa into Mexico

Tuxtla Gutierrez, (Chiapas, Mexico) – Mexico has noticed a rising number of Africans from the Horn of Africa coming across its borders headed to the United States.

The exodus of Africans has expanded while the economic situation in the U.S. has slowed the number of Central Americans migrating to the United States, according to Jorge Humberto Yzar, of the Instituto Nacional de Migracion, in the Mexican State of Chiapas on the border of Guatemala.

In the first trimester of this year, Mexico detected 400 migrants originally from the Horn of Africa entering into Mexico destined to the United States. The Horn of Africa is one of the poorest regions of the world. “One hundred and eighty –four of the Africans were from Eritrea, 47 from Ethiopia, and 165 were from Somalia”, says Yzar.

The official didn’t disclose figures detailing the entries of Africans during the second trimester. African migrants from Eritrea, Ethiopia and Somalia cannot be repatriated to their countries due to the conditions of poverty and insecurity in those countries, according to a humanitarian treaty signed by Mexico with the United Nations High Commission on Refugees.

“Under that International Treaty, we have to offer immigrants from those countries an opportunity to immigrate legally into this country or to offer safe passage for a period of 30 days, a period in which they may continue travel to the border of the United States,” confirmed Yzar.

The huge presence of African migrants has caught the attention of the whole border city of Tapachula, Chiapas, although the migrants have not affected the peace and security of the city.

Around 500.000 migrants, the major portion of which are Central Americans, cross into Mexico annually to cross into the United States, estimates the Mexican Human Rights Commission.

The city of Fremont, Nebraska approves anti-immigrant law

The residents of Fremont, Nebraska, gave the green light in the ballot box to a law similar to Arizona’s law that punishes migrants.

The law calls for the verification of legal status of anyone who works or lives in the city. It was approved by 57% of the vote. Only 45% of the registered voters participated.

The ordinance prohibits the lodging, renting or leasing residences to undocumented persons.

Before knowing the results last night, the Mayor, Donald “Skip” Edwards (who proposed a similar measure in 2008) guaranteed the will of the people.

Councilman Scott Getzschman, one of the principal backers of the measure, said the measure proves that “The people are tired of illegal immigration.”

According to Census figures, 25,500 people live in Fremont, 4.3 % of which are Hispanic and 30% of those were born in the United States.

The Pew Hispanic Research Center says that less than 1% of the residents of Fremont are undocumented.

The American Civil Liberties Union (ACLU) promised judicial action to prevent the implementation of the ordinance.

“This ordinance in not only against the Federal law but goes against the United States Values of justice and equality,” declared Laurel Marsh, Executive Director of the ACLU in Nebraska.

Councilman Gary Bolton said that he feels concerned about the tremendous expenses that will be incurred defending this ordinance because it contradicts Federal Law.

Councilman Getzschman said “The people are tired because the Federal Government is not addressing the problem. It is the responsibility of the Federal Government, but the Federal Government is not doing anything so the people have to do something”. He said that this is a grass roots effort similar to initiatives in other cities in Nebraska.

Kristin Ostrom, Director of an organization in Fremont named “Nebraska is Home,” (an immigrant help group) coordinated a campaign against the ordinance and said that the debate over immigration in Fremont has gone on for two years and was initiated by outside groups.

Ostrom blamed Attorney Kris Kobach of Kansas who wrote SB-1070 for Arizona who also wrote the ordinance approved in the Fremont election.

The services of Kobach were paid by the Federation for American Immigration Reform, (FAIR) a national organization known for its anti-immigrant stance. FAIR contributed $5,000 to the campaign to pass the ordinance in Fremont.

Mexico joins suit in federal court against Arizona law

Mexico, D.F. – Mexico filed an Amicus brief in Federal Court in Arizona against SB-1070. The Secretary of Foreign Relations filed a “Friend of the Court” brief in the case of Friendly House, et. al. Vs Michael B. Whiting, et.al.

By filing the brief, Mexico aligned itself with The Mexican American Legal Defense and Education Fund (MALDEF), the National Immigration Law Center (NILC), and the American Civil Liberties Union (ACLU) in order to overturn Arizona’s recently passed SB-1070.

In its Friend of the Court Brief, Mexico asks the Federal Court to declare the law unconstitutional, to block its enforcement and declares that it is fundamental and imperative that its citizens (U.S. Citizens) observe human and civil rights when encountering citizens of Mexico wherever they may be present in the United States.
