Man Who Sexually Assaulted Teen in Poway Sentenced to Prison

A man who sexually assaulted a 13-year-old boy after plying him with alcohol near a Poway middle school is scheduled to be sentenced to prison Thursday in a San Diego courtroom.

Jesus Mora Nava, 31, an illegal immigrant, pleaded guilty Nov. 15 to committing forcible lewd acts on a child and using false documents to conceal his true citizenship status.

As part of a plea agreement with prosecutors, Nava agreed to be sentenced to 16 years behind bars.

Prosecutor Dino Paraskevopoulos said the boy was standing outside Meadowbrook Middle School last July 16 when he was approached by a stranger, who turned out to be Nava.

The defendant asked the boy in Spanish if he had any drugs, and the teen said no, according to the prosecutor.

Nava left, but came back and offered the boy some beer, which he declined, Paraskevopoulos said. The defendant left again and returned with beer, and the boy had some to drink at that point, the prosecutor said.

Paraskevopoulos said Nava then took the boy with him to a nearby liquor store, when he bought more beer and hard liquor.

The defendant then took the victim to a transient encampment near the school and gave him watermelon and more beer before sodomizing the child after he passed out, the prosecutor said.

When the teen came to and started walking away, Nava followed and threatened the boy, telling him that if he said anything about the sexual assault, his family would be killed, Paraskevopoulos said.

Using a helicopter, sheriff deputies found the man about six hours later at the encampment.

Chairman, sheriff differ over deputies’ immigration role

Gwinnett County Commission Chairman Charles Bannister is calling for the county sheriff’s department to begin enforcing federal immigration laws.

Bannister wants Sheriff Butch Conway to sign up for a U.S. Immigration and Customs program that trains deputies to start deportation proceedings for illegal immigrants booked into the jail. Only two sheriff’s departments in Georgia participate in the program, but it is gaining in popularity.

Conway says he doesn’t have the resources to designate the five or six deputies needed for the task. Last year, there were 60 deputy vacancies, and a request for more than 40 additional deputies to fill staffing needs in 2008 was shot down by commissioners due to budget constraints, Conway said Wednesday.

“At this point, I just don’t have the personnel to do it, even if I want to,” Conway said.

Bannister argues the county must move forward with the issue of illegal immigration, even if it’s costly.

Immigration is a hot-button issue this year. Both the commission chairman and sheriff’s posts will be up for re-election this November. Georgia law only requires jails to check residency status of foreign-born inmates charged with a felony or driving under the influence. The ICE program trains deputies to check the residency status of any foreign-born inmates, regardless of their crime.

In 2007, Cobb County Sheriff Neil Warren became the first sheriff in Georgia to initiate the ICE program. Whitfield County in North Georgia will begin training some of its deputies this month, according to ICE spokeswoman Pat Reilly. Other in-state participants include a select group of state troopers and officers with the GBI and Department of Public Safety.

The ICE initiative is not new — it began in 2002 — but Reilly says there is a recent emphasis on promoting participation with state and local agencies because it serves as a “force multiplier,” putting more boots on the ground in the illegal-immigration fight.

Participation on the local level has risen. In 2002, 35 state and local law enforcement officers were trained. In 2007, 426 were trained.

There are currently two ICE agents stationed full-time at the Gwinnett jail. Last year, 360 inmates were deported and 127 were placed on hold pending further investigation into their residency status, according to the Gwinnett County Sheriff’s Department. Conway says he isn’t convinced that training deputies to enforce federal immigration laws will prove any more effective.

Commissioner Lorraine Green, who is running against Bannister for county chairman, also is skeptical. “There is some concern that we would lose the two ICE agents at the jail if we went to [the ICE program], and those are paid for by the federal government,” Green said.

Bannister says he plans to continue emphasizing the issue as part of his campaign platform. Conway is braced for a continued debate.

“There is a lot of illegal immigrant anti-sentiment,” Conway said. “I think it’s going to be a real hot-button issue in this year’s elections.”

Open border with Mexico?

Regarding those pesky borders and our nation: If anyone hasn’t “gotten it” yet, please read this from the Albany [Oregon] Democrat Herald.

This editor “gets it” – if we do away with our borders, we can do away with illegal immigration. Problem solved!

Think: “I pledge alligiance to the continent and to the commerce for which it stands”.

We have the North American Free Trade Agreement, which links the economies of the United States, Mexico and Canada. But this arrangement doesn’t seem to extend to the movement of people.

If it did, there would be no such person as an illegal alien from Mexico — or Canada — in the United States. Instead, citizens of each would be free to move from any one of the three countries to one of the others. They could live where they wanted and work wherever they were qualified to work, or where their labor was wanted and needed. In fact, Mexico already allows Americans to come in and stay indefinitely if they can support themselves.

Beginning Jan. 1, the state began demanding proof of income and citizenship for people to join or stay on Medicaid. Through April, the government insurance program for about 1.3 million of Georgia’s poor and disabled had an enrollment decline of 69,635.”

The E-Verify program, formerly known as Basic Pilot or the Employment Eligibility Verification System (EEVS), is jointly administered by the Department of Homeland Security (DHS) through United States Citizenship and Immigration Services (USCIS) and the Social Security Administration (SSA). This program allows participating employers to verify whether newly hired employees are authorized to work in the United States by checking the information provided by the employees on their Form I-9 against both DHS and SSA databases.

Participation in E-Verify is currently free to employers.
